Cost of Electronic Monitoring (Cost of Imprisonment)
First Time DUI or Refusal Offenses When Sentence Occurred Between 1/1/2017 and 7/9/2019
If you have been convicted of a first time DUI (Operating Under the Influence) or Refusal to Submit to Chemical Test and the sentence occurred between 1/1/2017 and 7/9/19, you must pay the cost of electronic monitoring directly to the court. This payment will be credited against the Cost of Imprisonment listed on your original judgment.
[Effective 1/1/2017, Senate Bill 91 required a defendant convicted of their first DUI or their first refusal ”shall” serve the sentence “by electronic monitoring at a private residence under AS 33.30.065. If electronic monitoring is not available, imprisonment required [for first-time offenders] shall be served at a private residence by other means determined by the commissioner of corrections.” Revised AS 28.35.030(k); similar language also in AS 28.35.032(o). Effective 7/9/2019, HB 49 eliminated this provision.]
To pay the Cost of Imprisonment, see Costs That Must Be Paid To Another Agency
Other Offenses
If the Department of Corrections or court approves you to serve your jail sentence by electronic monitoring for other offenses (including a subsequent DUI or Refusal offense), you must pay the electronic monitoring fees directly to the Department of Corrections’ electronic monitoring office.
IMPORTANT: Contact your local Clerk's Office to determine if the electronic monitoring fee can be credited towards the Cost of Imprisonment.
